Terms of Service

1. Scope

These Terms of Service (“Terms”) govern the contractual relationship between foto-huwi.ch Huwiler, Michael Huwiler, Signalstrasse 17, 9400 Rorschach, Switzerland (“pics4job”, “we”) and customers (“Customer”) regarding the online service pics4job.com for the AI-assisted creation of application and business portraits. By placing an order, the Customer accepts these Terms.

2. Scope of services

Based on the selfies uploaded by the Customer, pics4job creates professional-looking, AI-generated portraits. The number of images, the chosen backgrounds/outfits and the delivery time depend on the package selected during the ordering process. The images are generated entirely by artificial intelligence; they are not photographs of real shots.

3. Conclusion of contract

The contract is concluded upon completion of the ordering process (clicking the paid order button) and successful payment. The Customer receives a confirmation by email.

4. Prices & payment

The prices shown during the ordering process apply, in CHF or EUR, including statutory VAT. Voucher codes are credited according to their respective conditions.

Customers in Switzerland and Liechtenstein pay in CHF via our payment service provider Payrexx (card, TWINT, etc.); an invoice in PDF format is sent by email.

Customers outside Switzerland/Liechtenstein pay in EUR via Creem (Armitage Labs OÜ, Telliskivi 57b/1, 10412 Tallinn, Estonia). Creem acts as the “Merchant of Record” (the contractual reseller for the payment) and is responsible for calculating, collecting and remitting the applicable VAT; the corresponding invoice with VAT is issued by Creem separately by email. The service itself, the creation of the portraits, is provided by us.

5. Delivery

The generated portraits are provided to the Customer digitally, in the personal order area (download link) and via email notification. Depending on the package, delivery usually takes from a few minutes up to 24 hours. If processing is exceptionally delayed (e.g. because uploaded images cannot be processed technically), we inform the Customer by email.

6. Customer cooperation & permitted content

The Customer warrants that they hold the necessary rights to the uploaded selfies and upload exclusively images of their own person. Uploading images of third parties without their consent, as well as unlawful, offensive or obviously unsuitable content (e.g. nude images, other people, non-portraits), is prohibited. We reserve the right to refuse or not process such orders.

The service is exclusively for creating professional-looking business portraits from the Customer's own selfies. There is no free-form text input (prompting). Using the service to create sexually explicit, pornographic or sexually suggestive (NSFW) content is prohibited; uploaded images are screened automatically and unsuitable content is rejected.

7. Rights of use

The Customer receives an unlimited (in time and territory), non-exclusive right to use the delivered portraits for private and commercial purposes (e.g. job applications, social media profiles, websites). There is no artistic copyright in AI-generated images. We recommend transparently communicating the AI origin when using them in an application context.

8. Satisfaction & refunds

We want you to receive a result that is usable for your purposes. If the delivered images are defective or unusable, we will re-generate them free of charge where possible. If we are unable to deliver the assured number of images in usable quality, we will review the case individually and refund the amount in full or in part. See our Refund Policy.

Quality promise
The portraits are generated by sophisticated algorithms using AI. It is in the nature of things that you will not like absolutely every image. To counter this, depending on your package you can generate a number of additional variants free of charge. You can expect at least 3–6 satisfactory portrait images. Should none of the provided shots meet your requirements, we offer you a renewed image generation free of charge.

A full refund is only possible in absolutely exceptional cases, for example in the event of technical malfunctions.

9. Right of withdrawal / return

The portraits we provide are digital content made individually for the Customer: they are generated exclusively from the Customer's own uploaded selfies and are created and made available immediately after the order.

Consumers in the EU: distance contracts generally carry a 14-day right of withdrawal. However, this right is excluded for goods/content made to the consumer's specifications or clearly personalized (Art. 16(c) of Directive 2011/83/EU; e.g. § 312g(2) no. 1 German Civil Code). As our portraits are personalized from the Customer's own selfies, no right of withdrawal applies.

Insofar as this concerns digital content not supplied on a tangible medium, by placing the order the Customer also expressly consents to us beginning performance (generating the portraits) immediately after payment and acknowledges that they thereby lose their right of withdrawal (Art. 16(m) of Directive 2011/83/EU; § 356(5) German Civil Code).

For sales via our Merchant of Record (Creem, EUR market), its buyer terms additionally apply. Independently of the statutory right of withdrawal, we voluntarily grant the goodwill and refund policy set out in section 8.

10. Liability

We are liable for damages only in cases of intent and gross negligence. Liability for slight negligence as well as for indirect and consequential damages is excluded to the extent permitted by law. We accept no liability for damages arising from the use of the images in impermissible or misleading contexts.

11. Data protection

The processing of personal data, in particular the uploaded selfies and the generated portraits, is governed by our Privacy Policy.

12. Applicable law & place of jurisdiction

Swiss law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction is Rorschach (Canton of St. Gallen), unless mandatory statutory provisions prescribe a different place of jurisdiction.

13. Final provisions

Should individual provisions of these Terms be invalid, the validity of the remaining provisions shall remain unaffected. We reserve the right to amend these Terms; the version published at the time of the order applies to that order.
